Terms & Conditions
These terms apply to trips booked with Marlow Cove Charters and to your use of this website. By booking a trip, you agree to them.
Booking and payment
- A trip request or inquiry is not a confirmed booking until we confirm it with you directly.
- Deposit: $100 Deposit to hold your trip
- Cancellation: A deposit holds your date and is non-refundable, but it can be applied to a rescheduled trip within 12 months. If we cancel for weather, your deposit is refunded in full or moved to a new date, your choice.
- If we book through a third-party booking platform, that platform's payment and cancellation terms also apply.
Weather and safety
The captain has sole discretion to delay, reroute, shorten, or cancel any trip for weather, sea conditions, mechanical issues, or safety concerns. If we cancel a trip before departure for these reasons, you may reschedule or receive a refund of amounts paid for the trip.
Your responsibilities
- Arrive on time at the agreed departure location (typically Marlow Cove Town Dock).
- Follow the captain's and crew's safety instructions at all times.
- Tell us in advance about medical conditions, mobility limitations, or other needs that could affect the trip.
- Guests under the influence of drugs or excessive alcohol may be refused boarding without refund.
Assumption of risk
Fishing and boating carry inherent risks, including weather, sea conditions, and the use of hooks, gaffs, and other equipment. To the fullest extent permitted by law, you participate at your own risk, and Marlow Cove Charters is not liable for personal property that is lost or damaged on a trip. Nothing in these terms limits liability that cannot be limited under applicable law.
Licenses and catch
Where regulations allow, guests fish under the boat's licenses and permits. All catch is subject to applicable fishing regulations, seasons, and limits, which the captain follows without exception.
Photos
We occasionally take photos on trips for use on this website and social media. Tell us before departure if you prefer not to be photographed.
Governing law
These terms are governed by the laws of MA, without regard to conflict-of-law rules.
